Full garden design for sites under 100 sqm, without significant changes in level or substantial tree coverage, including hard and soft landscaping, are charged @ £2,000 plus VAT.

These Terms & Conditions apply to all Design services provided by Novaterra Landscaping Ltd, a company registered in England and Wales (Company No. 9442831), whose registered office is at 4 Kennedy Road W71JN, trading as ‘Novaterra gardens & landscapes’ (the Designer) to the Client.
1. Scope of Services
1.1 The Designer will provide the following services as outlined in the written quotation:
1.2 The Designer will carry out a basic garden survey as part of the design fees, marking out key landscape and hardscape features. For large and complex sites, particularly in terms of levels, or gardens with substantial tree coverage, additional charges may apply, or we may advise you to commission a detailed land or arboriculture survey.
1.3 The design will be based on the Client and site's requirements. The budget is used for guidance. The Designer is not liable for construction costs exceeding the budget provided. The design will be aspirational and show the most attractive and functional scenario so the Client can evaluate where to best spend their budget.
1.4 Mood board images of hard landscaping materials, features, plants and reference gardens are for indicative purposes and should not be taken as exact representation of the finished project. These are to complement the written specifications of hard and soft landscaping, which should take precedent. 3D Visuals are for illustrative purposes and should not be taken as exact representation of the finished project. Hard landscape construction drawings are not included in the fees. These can be provided for an additional charge, if required.
1.5 Plants in the planting selection boards are shown at their mature size and best season. They will, however, flower at different times and be supplied young, at smaller sizes. Substitutions may be needed depending on plant availability at time of implementation. These will be agreed with the client beforehand.
1.6 The total number of plants will be estimated based on the area and layout of planting beds/ borders and a proportionate breakdown by plant type will be calculated for budgeting/ quoting purposes. Generally, the smaller the plant the greater the quantity. Exact plant quantities and plant locations will be decided at implementation stage. Detailed planting plans are not included in the fees. These can be provided for an additional charge, if required.
1.7 We provide electronic pdf copies of all stages of the project and hard copies of all drawings.
2. Quotation
2.1 The Garden Design quotation is valid for a period of thirty days from the date shown in the quotation and thereafter lapses automatically.
2.2 A quotation for implementing the design will be given to the Client by Novaterra Landscaping team after the design is agreed, the geometry decided, and materials chosen. If construction costs exceed the client’s budget, the design will need to be scaled down to the elements that are essential to the scheme, and materials simplified so they are affordable within the Client’s budget. Alternatively, the design could be implemented in phases.
3. Variations
3.1 One set of changes to the final layout plan is provided free of charge, if required.
3.2 Further revisions will be charged separately (at a rate to be specified in writing), including any design amendments resulting from changes to the client's brief, variations to layout/ materials in order to meet budget or from the discovery of site hazards or obstructions, which were not discoverable upon visual inspection of the surface of the site at survey stage.
3.3 Any changes required to the 3D model views will incur additional fees.
3.4 Additional meetings or site visits not included in the original scope will be charged separately.
4. Payment
4.1 Fees will be set out in the written quotation.
4.2 Fees are payable prior to the start of each phase of work for Stages 1 and 2. The fees for Stages 3 and 4 will be charged together prior to the start of Stage 3.
4.3 Stages 3 and 4 are optional. 3D views may not be required for very small gardens or clients may wish to do the planting themselves.
3.4 Work will not commence until payment has been received. Invoices are payable within 7 days of issue unless otherwise stated. Late payments may incur interest of 5%.
5. Client Responsibilities
The Client agrees to:
6.1 All drawings, plans, visuals, and documents remain the intellectual property of Novaterra Landscaping Ltd, trading as ‘Novaterra gardens & landscapes’.
6.2 The design is licensed to the Client for one-time use at the specified property only.
6.3 Designs may not be copied, reproduced, or used at another location without written permission.
6.4 The Designer reserves the right to photograph the completed project and use images for marketing purposes unless otherwise agreed in writing.
7. Project Timeline
7.1 Each phase of work of the Design or ‘Stage’ is estimated to last approximately 4 weeks but may vary depending on:

9.1 The Designer’s liability is limited to the total design fees paid.
9.2 The Designer is not liable for:
10.1 Plant and materials performance cannot be guaranteed due to environmental factors beyond the Designer’s control.
10.2 Aftercare guidance may be provided but ongoing maintenance is the Client’s responsibility unless separately agreed.
11. Insurance
Novaterra Landscaping Ltd, trading as ‘Novaterra gardens & landscapes’, maintains professional indemnity insurance appropriate to the services provided.
12. Confidentiality & Data Protection
Client information will be treated as confidential. Personal data will be processed in accordance with UK General Data Protection Regulations (GDPR) & Data Protection Act 2018.
13. Law
This contract and any dispute or claim arising out of it or in connection with it or its subject matter shall be governed by and construed in accordance with the law of England and Wales.
14. Acceptance
Acceptance of the written proposal and/or payment of the fees constitutes acceptance of these Terms & Conditions.

8. Cancellation & Termination
- If the Client cancels after work has commenced any fees already paid are non-refundable. The Client will be invoiced for work completed up to the date of cancellation.
9. Limitation of Liability
9.1 The Designer’s liability is limited to the total design fees paid.
9.2 The Designer is not liable for:
- Damage caused during installation
- Plant failure due to poor maintenance, weather, soil conditions, pests or disease
- Structural issues not identified during site assessment
10.1 Plant and materials performance cannot be guaranteed due to environmental factors beyond the Designer’s control.
10.2 Aftercare guidance may be provided but ongoing maintenance is the Client’s responsibility unless separately agreed.
